In this document we describe the information you must provide us so that you can make optimal use of all My-Link services and functionalities.

For My-Link privacy is an indispensable element in the management and use of any application or digital platform. To support this, we offer our Services seeking to guarantee at all times the security and total protection of your data, so that only you can decide what content you share and with whom.

We are committed to protecting and respecting your data and your privacy. This policy sets out the basis on which we treat any personal information we collect or that you provide to us. If you do not agree to this Policy, you should not use the Platform.

By accepting the Terms of Service, you affirm that you agree to the Data and Privacy Policy and give My-Link the necessary permissions on your information for the proper performance of its Services.

1. Information.

1.1. What information do we collect?

The type of information we collect depends on how you use our application, as detailed below:

Personal or business information and content you provide on the application. This refers to the information you provide when you register on the Platform, including username, date of birth, email address and/or phone number, and information you share in your User profile.

Also, communications, registration data, content created and shared through posts or messages with other people or businesses, metadata, locations, and everything related to this information, in order to provide you with services and recommendations that may be of interest to you.

Your location data, provided that the option is enabled by the User, to provide you with information that may be of interest to you about other users or to show you recommendations and topics of local interest. You can enable the option of location in the "background", to receive notifications or recommendations regarding the place where you are.

Event or personal interest data.

Information related to your health. That you can share according to the privacy settings you select in your Health Account (as soon as the feature is available).

Information about the people, accounts, profiles and hashtags you interact with or are connected to and how you do so, as well as contact information for syncing or importing from a device.

Information about how you use our app and its products, such as the types of content you view or interact with, the features you use, the actions you take, the people or accounts you interact with, and the time, frequency and duration of your activities.

Information about transactions made within the application and its products. Such data may include payment information, as well as account and authentication data, billing, shipping and contact details. • Information about transactions made within the application and its products. We also receive other users' activity and the information they provide about you.

Information, features, operations, behaviors, identifiers, signals, configuration data, network and connections, computers, phones and other internet-connected devices that you use to use our application and its products.

1.2. How do we use the information provided?

We use the information we collect in the following ways:

To notify you about changes to our Services, to provide User support, to enforce our Terms, Conditions and Policies, to administer the Platform, including troubleshooting, to guide the recommendations you receive and provide you with specific content that may be of interest to you, to interact with other users, and to enable our messaging service if you choose to use that feature.

To provide the Platform to you and to improve and manage it. Where it is in our legitimate interests, we will use your information, among other things, to improve and develop the Platform and to ensure your security.

In order to comply with our obligations to governmental authorities, we use your information to detect abuse, fraud and illegal activities on the Platform, and to sanction accounts that violate our terms.

My-Link does not send unsolicited advertising, however, we may use your personal information to provide you with recommendations and, where appropriate, to promote the Platform.

With your consent, we will use your location information to provide you with recommendations or targeted advertising and other services. Where those services are available, you choose to share your precise, real-time location with us.

1.3. Security of your information.

We take steps to ensure that your information is handled securely and in accordance with this Policy. However, for reasons beyond our control, the transmission of information via the Internet is not completely secure. Although we do our best to protect your personal information, for example, with encryption, we cannot fully guarantee the security of information transmitted through our Platform; any transmission is at your own risk. For this reason, My-Link disclaims liability in case your information is used by someone else outside our services.

We have appropriate technical and organizational measures in place to ensure a level of security appropriate to the risk of variability and severity of your and other users' rights and freedoms. We maintain these technical and organizational measures and may modify them to improve the overall security of our systems.

We, or our users from your Personal Account, Pro Account, VIP Account, Business or Business Plus, may include links to and from the websites of other partner networks, personal sites, advertisers and affiliates. If you follow a link to any of these websites, please note that they have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before you submit any information to these websites.

1.4. Your rights over your information.

You have all rights in relation to your information, such as the right of deletion, the right of access, the right of portability, and the right to share and publish, as long as these Terms of Service or Data and Privacy Policies are not violated or transgressed.

The use you make of your information in exercise of these rights within our platform is your responsibility, so we are not responsible for, nor do we support or encourage you to publish sensitive or confidential information about yourself publicly.

1.5. How long do we keep your information?

We retain your information for as long as necessary to provide the service, so that we can fulfill our contractual rights and obligations regarding the information in question.

In the event that we do not require your information to provide the service, we will only retain it for as long as we have a legitimate commercial purpose for retaining it. However, there are occasions when we are likely to retain this data for longer in accordance with our obligations to governmental authorities, or when it is necessary for the establishment, exercise or defense of legal claims

To revoke your consent to the processing of your personal data, it is important that you keep in mind that not in all cases we will be able to respond to your request or terminate the use immediately, since it is possible that we may be required by law to continue processing your personal data.

Also, you should consider that, for certain purposes, the revocation of your consent will mean that we can no longer provide the service.

1.6. How and with whom do we share your information?

My-Link does not share your information or data with third parties or business partners, unless we have your express permission through the Platform or some other legal instrument.

When required by law, we will share your information with law enforcement agencies, regulators, public authorities or other organizations, if legally required to do so, and pursuant to a legally binding court order.

This information will be shared as we obtain it from the Platform, so some or all of the data we provide to these parties may be encrypted. Since we do not have access to private keys, My-Link will have no obligation to interpret or decrypt this information for analysis or lawful use.

We may also share your information based on our legitimate business interest if such use is reasonably necessary to:

To comply with a legal obligation, process or request;

Enforce our Terms of Service and other agreements, policies and standards, including investigation of any potential violations thereof;

Detect, prevent or address technical or security problems or potential fraud; or

Protect the rights, property or safety of us, our users, a third party or the general public as required or permitted by law.

2. Permissions.

2.1. Permissions you grant to My-Link.

My-Link does not share your information, content or statistical data with third parties. This information is managed and safeguarded by My-Link, and each User decides the amount and type of information that he/she shares with the community from his/her Accounts

However, for the correct use and operation of some functions of My-Link, you agree to grant us the following permissions:

Permission to display your name and User image and Linkname of your Personal, Pro, VIP or Business and Business Plus Accounts; so that other people can easily find you and can request information from you, including zones, spaces and My-Link sites.

Permissions to display your Business or Business Plus Accounts data, in their standard or VIP modalities. Please note that, for reasons of usability of the Platform, all data you share from these profiles will be public, including areas, spaces and My-Link sites.

Permission to show you publications, advertising or promotions of the Personal, Pro, VIP, Business or Business Plus Cards that you "follow" or have saved in your Wallet, including zones, spaces and My-Link sites.

Permission to show you publications, advertisements and promotions, in your general "feed" or timeline, in the "Featured" section or within the Business sections you access, including My-Link areas, spaces and sites.

Permission to update the software you use or download, this in order to continue enjoying the improvements that we will be making to our application and its products or services.

Location permission. To provide you with location-based services (where those services are available and you choose to share your precise location with us).

Background location permission. For viewing devices near your location.

SMS messaging and call logging permission. For logging incoming calls through My-Link and to the system for sending and receiving SMS messages for login and phone number confirmation as a double authentication, as well as sending selected messages through My-Link chat.

Storage permission. To read and save downloaded files and multimedia.

Microphone permission. For recording audio, video and voice messages.

Camera permission. For taking pictures, video and viewing Augmented Reality (AR) content.

3. About Advertising.

For My-Link, the user's privacy is a priority, so it does not use advertising identifiers of the user's devices (iOS and Android) nor track their activity outside the application.

My-Link, on the other hand, makes use of the indicators that the user explicitly selected as of interest and importance to show him a 'Feed' or 'Timeline' with relevant information or content of the accounts he follows. We also show him content that we determine may interest him, based on the aforementioned indicators, such as nearby Business profiles, advertised on a site close to the user, or categories of general interest, in the 'Featured' section.

My-Link advertising is based on and presented as recommendations and is not influenced by or shared with agents external to our services.
